Welcome to Pick’A Pic. By booking our photographic services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before making a booking.
1.1. "Company" refers to Pick’A Pic, operating under the legal name of Ms. Caroline Ty and collaborators which includes photographers and videomakers.
1.2. "Client" or "Clients" refer to the individuals or entities booking and receiving the photographic services.
1.3. "Services" refers to the photographic services provided by the Company.
2.1. All bookings are subject to availability and confirmation by the Company.
2.2. A confirmed payment is required to secure the booking.
2.3. Payment can be made via Stripe, Cash or online platforms.
2.4. Prices are subject to change without prior notice. However, confirmed bookings will be honored at the agreed rate.
3.1. Cancellations made within the notice period specified at booking will qualify for a refund, as outlined in the cancellation policy shared at the time of booking.
3.2. Late cancellations or no-shows may forfeit payments as per the cancellation policy.
3.3. If the Company cancels, a refund or rescheduling option will be provided.
3.4 The retainer fee shall be refundable exclusively within seven (7) days from the date of payment confirmation. Upon expiration of this period, the retainer fee will no longer be refundable.
4.1. Rescheduling requests will be evaluated based on the Company's availability. If an agreement can be reached within the notice period specified at the time of booking, the new appointment will be confirmed; however, rescheduling is not guaranteed, and in the event of the Company's unavailability, no refund will be provided.
4.2. In the case of adverse weather conditions, the Company will allow rescheduling up to a maximum of twenty four (24) business hours prior to the scheduled start time.
4.3. Rescheduling requests made after the twenty four-business-hour cutoff time will not be honored. If the Client does not appear at the scheduled time, the booking will be treated as a no-show, and no refund will be provided.
5.1. The Company is not liable for any direct, indirect, or incidental damages arising from the use of its services.
5.2. The Company is not responsible for injuries, accidents, or property damage during the photoshoot.
5.3. The Company is not responsible for theft or loss of personal belongings during the photoshoot. Clients are advised to take precautions and remain vigilant, as photoshoot locations may be crowded or prone to pickpocketing.
6.1. Clients are responsible for ensuring required permissions or permits for their chosen shoot location.
6.2. Punctuality is essential. Delays may result in a shortened session or additional fees.
6.3. Clients are responsible for securing and monitoring their personal belongings during the session.
7.1. Photo editing includes basic color correction and adjustments.
7.2. Advanced edits, such as removing background elements or heavy manipulation, are not included.
7.3. Additional editing requests may be evaluated on a case-by-case basis and could incur extra charges.
8.1. Package Details: Specific details about inclusions, exclusions, and requirements for special packages will be shared at booking.
8.2. Third-Party Services: For activities involving third parties (e.g., gondola rides), Clients are responsible for associated costs and compliance with the terms of those providers.
8.3. Special Requests: Any special requests, such as champagne openings, must be communicated to the Company in advance. Approval for these activities is at the discretion of the gondolier, and the Company has no control over their decisions.
8.4. Weather Conditions: In cases where external factors (e.g., weather) affect the availability of certain services, adjustments or alternatives will be offered without loss to the Client for services not rendered. However, it is the Client's responsibility to respond promptly to the Company's requests for rescheduling. If the Company does not receive a response, the Client is not entitled to any refund if they fail to show up at the scheduled meeting time.
9.1. Clients are required to carefully read, understand, and comply with all delivery instructions provided by the Company. Failure to do so shall not constitute grounds for complaint or liability on the part of the Company.
9.2. The number of downloadable photos is strictly limited to the quantity expressly indicated in the selected package. Under no circumstances may this limit be exceeded. Clients acknowledge and accept full responsibility for adhering to this limitation.
9.3. The Company shall not, under any circumstances, be liable for misunderstandings, misuse, or errors attributable to the Client. Any attempt to download photos in excess of the package limit requires the mandatory purchase of the full gallery through the designated Add-On. Failure to comply does not entitle the Client to additional downloads, refunds, or claims of any kind.
10.1. Based on the art. 98 of the Italian Legislation no. 633 of 22 April 1941 and Italian's Highest Court of Appeals no. 4094 of 28 June 1980, it is hereby established that the negatives and original files produced remain the exclusive property of the author.
10.2. Clients are authorized to use the images solely for private, non-commercial purposes; the transfer of images to third parties, including other service providers, is not permitted without the author’s prior written consent.
10.3. In accordance with Regulation (EU) 2016/679 (GDPR) and Legislative Decree 101/2018, Clients may request the removal of their images from any platforms on which they have been published.
11.1. The Company respects Clients’ privacy and protects personal information.
11.2. Full details of our privacy practices are outlined in our Privacy Policy.
12.1. The Company is not liable for non-performance due to events beyond its control (e.g., severe weather, natural disasters, or other unforeseen circumstances).
12.2. If such events occur, the Company may reschedule or cancel services for safety reasons. Clients will be offered the option to reschedule or cancel.
12.3. Clients must respond to rescheduling requests. Lack of response will result in the original booking being upheld. If the Client does not appear at the scheduled time, it will be considered a no-show, and no refund will be issued.
12.4. The Company will wait up to 15 minutes past the scheduled start time. If the Client is not present and no communication is received, the booking will be marked as a no-show.
13.1. These Terms and Conditions are governed by and construed in accordance with the laws of Italy.
13.2. Any disputes will be subject to the exclusive jurisdiction of Italian courts.
14.1. The Company reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any significant changes.
By proceeding with the booking, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
